What Is HB 2014?

House Bill 2014 — the Power Generation and Consumption Act — passed the West Virginia Legislature in 2025 with overwhelming support. It created the "High Impact Intelligence Center" (HIIC) designation, allowing qualifying data center projects to bypass local zoning and receive special state tax treatment.

Key Community Impacts: HB 2014 eliminated Berkeley County's local zoning authority over the Penzance campus, stripped an estimated $7.5 million annually from Berkeley County schools, and enabled the project without mandatory community input, environmental assessments, or water usage disclosures.
What HB 2014 Does:
  • Creates a state-level designation that bypasses local zoning for qualifying projects
  • Establishes special tax treatment for data centers investing over $2 billion
  • Removes county government authority to review, condition, or block qualifying projects
  • Redirects tax revenue away from county schools via a new state distribution formula
  • Requires no community engagement, environmental impact assessment, or water usage disclosure
May 2026 Legislative Response:

On May 18–19, 2026, WV House delegates held planning meetings with data center transparency as a central agenda item — the first formal legislative acknowledgment that HB 2014 has created unresolved problems. State Tax Commissioner Matt Irby revealed the state “doesn't really have a data center to value,” raising serious questions about whether economic projections used to justify the bill were reliable.

November 3, 2026

General Election — Open to All Registered Voters

The first general election after HB 2014 passed. All registered voters participate — no party restriction. Primaries concluded May 12, 2026.

Independent / no-party candidates: Unaffiliated candidates can still petition onto the November ballot. Gather signatures (1% of last general-election vote for the office, minimum 25) using credentials from the county clerk, then file with the SOS or county clerk by August 3, 2026. SOS guide

Independent / no-party candidates: Unaffiliated (“no party organization”) candidates do not appear on the May 12 primary ballot and are not in the January SOS export behind this list. To qualify for the November 3 general election, a candidate must (1) obtain an Official Credentials Form from the county clerk in each county where signatures are collected, (2) gather valid signatures on a nominating petition equal to at least 1% of the entire vote cast at the last general election for that office (minimum 25), and (3) file a Certificate of Announcement, nominating petition, and filing fee with the Secretary of State (federal, statewide, Senate, House, judicial) or county clerk (county-only offices) no later than August 3, 2026. Petition gathering can begin before that deadline; candidates may also register as pre-candidates to raise and spend campaign funds. Primary losers may not switch to this route for the same office (WV SOS Running for Office Guide, 2026, W. Va. Code § 3-5-23).
